1. Who we are

BuildaTea is operated by Futurewrks LLC (“we,” “us,” or “our”). “You” means the person using the site or placing an order.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to place an order. The store currently serves customers in the United States only, and orders ship to U.S. addresses.

3. Custom, made-to-order products

Each blend is produced to the recipe and options you configure, specifically for your order. Because products are made to order, all sales are final except where an item arrives defective or damaged, or is not what you ordered. Your rights in those cases, and how to request a remedy, are described in our Shipping & Returns policy, which forms part of these Terms.

4. Pricing and payment

All prices are shown in U.S. dollars. The final price for your blend is calculated on our server and shown to you at checkout before you pay; that displayed total is the price that governs. Shipping is added at checkout, and any applicable taxes are shown before payment.

Payment is processed by Stripe on its secure checkout page. Your order is not confirmed until payment is completed and we send an order-confirmation email. We may cancel or refuse an order — for example, if an item was mispriced, is unavailable, or the order appears fraudulent — and if we do, we will not charge you, or we will refund you.

5. Accounts

You can check out as a guest or create an account. If you create one, you are responsible for keeping your credentials secure and for activity under your account. If you place a guest order and later create an account with the same verified email address, you may claim that order into your account.

6. Ingredient, allergen, and health information

BuildaTea sells food products (teas, herbs, botanicals, and powders). Ingredient, caffeine, and allergen information is shown as you build your blend and in our Allergen & Ingredient Information. This information is provided for general purposes only and is not medical or health advice. Our products are not intended to diagnose, treat, cure, or prevent any disease. If you are pregnant or nursing, have a medical condition or allergy, or take medication, consult a qualified healthcare professional before use. You are responsible for reviewing the ingredient and allergen information for your blend before ordering.

7. Acceptable use

You agree not to misuse the site — including attempting to interfere with its operation or security, access it through automated means beyond ordinary browsing, submit false information, or use it for any unlawful purpose.

8. Intellectual property

The BuildaTea name, logo, site design, text, and graphics are owned by Futurewrks LLC or its licensors and are protected by applicable law. You may not copy, reproduce, or use them without our prior written permission.

9. Disclaimers

The site and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Futurewrks LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold Futurewrks LLC harmless from claims, losses, and expenses arising out of your misuse of the site or your violation of these Terms or of applicable law.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or your use of the store will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction, except where applicable law provides otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. Orders are governed by the Terms in effect when you place them. Your continued use of the site after an update means you accept the revised Terms.
